The terms and conditions outlined in this document constitute the entire understanding and full and complete agreement between you, the party as specified in the application (CLIENT), and Register.ly (PROVIDER).

“Our Data Processing Agreement under the European General Data Protection Regulation (GDPR) forms part of these Terms of Service.”

By using the Register.ly Web Site, Hosting Services, Domains, any Support Services, any Register.ly software, or any other products or services of Register.ly, you agree to be bound by the terms of this Agreement. The terms contained within this document super cedes and replaces any other agreement or negotiation between you and Register.ly, whether oral, written or otherwise, including any statements made to you by any representative of Register.ly at any time. Any amendments, changes, additions, deletions or other modifications of this Agreement are void unless specifically expressed in writing and agreed to by Register.ly.

The parties acknowledge and agree that neither of the parties is entering into this Agreement on the basis of any representations or promises not expressly contained herein.

The Register.ly’s Vision, Mission, and Goals

Register.ly helps organizations of all sizes to successfully do business online. Since 2002 we have been offering our clients state of the art domain registration, web development, design, software and hosting services.

Payment of Fees

I. Price change. PROVIDER has the right to change the price of the services at any time with 30 days’ notice. Services can be priced on the Register.ly website, www.Register.ly or submit a ticket or contact us page.

II. Fees. CLIENT agrees to pay a setup fee, a yearly fee, a usage fee (if any), and a web traffic fee (if any). The setup fee and first yearly fee is due upon sign up. PROVIDER will present a fee schedule to CLIENT before signing up.

Terms and Uses

I. Terms. CLIENT can terminate the services with advance notice in writing only to the billing department by mail, or e-mail [email protected] CLIENT understands that there will be no reimbursement and no pro-rate if he or she decides to terminate the services before the end of a prepaid term, regardless of the reason for the termination. PROVIDER can terminate this agreement at the end of a billing period, with a 30 days notice. PROVIDER can terminate the agreement immediately without any compensation if CLIENT does not comply with the “Acceptable use policy” (see III)

II. No Partnership or Agency. Nothing in this Agreement shall be construed as creating a joint venture, partnership, agency, employment relationship, franchise relationship or taxable entity between the parties, nor shall either party have the right, power or authority to create any obligations or duty, express or implied, on behalf of the other party hereto, it being understood that the parties are independent contractors vis-à-vis one another.

III. Acceptable Use Policy. Register.ly strictly enforces compliance with its acceptable use terms. You agree to maintain your website in full compliance with the terms set forth below. Failure to comply is cause for immediate suspension and possible termination of services with no reimbursement or refund of any kind. CLIENT agrees to not violate laws, regulations, or other requirements of any applicable Federal, State, or local government. CLIENT agrees to not engage in any activity of any kind that causes harm or encourages or consists of any threat to minors, persons, or property or to perform any activity which is likely to cause such harm. CLIENT agrees not to make or attempt any unauthorized access to any Register.ly website or the website of any Register.ly client.

CLIENT agrees not to violate any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. CLIENT agrees not to post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws.

IV. Excused Performances. Provider shall not be held responsible for, or to have breached any provision of this Agreement as a result of any delay, failure in performance or interruption of the Services, resulting directly or indirectly from acts of God, acts of civil or military authority, civil disturbance, war, strikes or other labor disputes and disturbances, fire, transportation contingencies, shortages of facilities, fuel, energy, labor or materials, or laws, regulations, acts or order of any government agency or official thereof, other catastrophes, or any other circumstances beyond the control of the PROVIDER. In the event of any such delay or failure, the parties shall defer performance of the Services to a date and time mutually agreeable.

V. “Unlimited” usage policies.

“Unlimited” usage policies and definitions apply only to shared hosting.
What does unlimited mean?
Register.ly will only provide unlimited space and email accounts if the client is committed to the terms and conditions of this package.

Shared hosting stands for a group of websites hosted on one server. Thus, this service is only suitable for small businesses and start-ups, and it does not fit mid/big enterprise websites. Also, it was not designed for web applications which are preferable to be hosted on Dedicated servers.

To ensure fairness for all clients using this service, Register.ly has the absolute right to apply limits and guarantees that prevent the misuse of this service.

Register.ly does not set limits on the amount of disk space a client can use for their website, provided the client’s use of storage complies with these Terms. Please note, however, that the unlimited plan is designed to host small websites. Register.ly does NOT provide unlimited space for online storage, backups, or archiving of electronic files, documents, log files, etc., and any such abuse of the service will result in the termination of the account, with or without notice. Accounts with a large number of files (inode count in excess of 250,000) can have an adverse effect on server performance. Similarly, accounts with an excessive number of MySQL/PostgreSQL tables or of database size (i.e., in excess of 3GB total MySQL/PostgreSQL usage or 2GB MySQL/PostgreSQL usage in a single database) negatively affect the performance of the server. Register.ly may request that the number of files/inodes, database tables, or total database usage be reduced to ensure proper performance or may terminate the account, with or without notice.

Register.ly does not limit the amount of visitor traffic a website can receive in a given month as long as the client’s use of the service complies with these Terms. In most cases, a client’s website will be able to support as much traffic as the client can legitimately acquire. Register.ly reserves the right to limit processor time, bandwidth, processes, or memory in cases where it is necessary to prevent negatively impacting other services on the same server.

Register.ly does not limit the number of parked domains and subdomains a client can associate with the unlimited plan. However, we do limit the addon domains to 5 domain names.

VI. Liability. CLIENT specifically hereby waives any claim for damages of any kind, whether direct, indirect, special, exemplary, punitive, incidental or consequential, loss of profits or loss of business as the result of any action taken in response to any claim of copyright infringement and/or violation of acceptable use policy without regard to whether or not the material claimed to have been infringing is later found to be infringing and/or in violation of the acceptable use policy.

VII. ASSIGNMENT. This agreement and the rights hereunder are not assignable or transferable except that Register.ly may freely assign all of its rights hereunder to any person or entity who shall become a principal owner, successor, or shareholder of Register.ly, or to any affiliated company or successor in interest of Register.ly. Any other attempted transfer or assignment of rights hereunder shall be null and void. Upon any such assignment by Register.ly to any other party, including to any affiliated company or successor in interest of Register.ly, you have the right to terminate this Agreement by giving notice thereof in writing to Register.ly, and any such termination shall become effective thirty (30) days after the receipt of such notice by Register.ly

VIII. CHOICE OF LAW. This Agreement shall be interpreted under the laws of Canada without regard to any conflict of laws provisions

Terms of .ly domains

Any.LY domain name may be registered, except domains containing obscene and indecent names/phrases, including words of a sexual nature; furthermore, domain names may not contain words/phrases or abbreviations insulting religion or politics or be related to gambling and lottery industry or be contrary to Turkish law or Islamic morality, the same applies to the site content.

In principle, you are free to choose the domain name. However, you cannot choose names that are in use by other organizations or names that, for various reasons, are prohibited or reserved for technical, ethical or national considerations. You also have a duty to ensure that your registration of a domain name does not infringe on another party’s right to the same name. Remember that the responsibility always rests with you. Registration of Ly Domains Terms and Conditions (Registration Agreement)

Domain names are registered for a period of one year to a maximum of 10 years at a time.

Registration fees are payable by credit card, bank wire transfers, cash, or checks upon application.

If domain name deletion should occur due to non-payment, the registration fees remain due and payable to Register.ly.

By registering a domain name through Register.ly, the applicant agrees that Register.ly does not give any legal rights to that name. Any disputes between parties over the rights of use of a particular name are to be settled between the contending parties using normal legal methods.

Applying for the domain name and through the use or continued use of the domain name, the applicant agrees to be bound by these terms and conditions. Register.ly is not responsible for checking the applicant’s right to use any name, and it is up to the applicant to ensure they are not infringing any registered trademarks. Register.ly will obey any legal order and reserves the right to suspend the use of any domain.

Register.ly is not responsible nor will be held accountable for any disputes, fees, penalties or charges laid on the applicant over rights to use a particular name, .ly domain registration and renewal fees are non-refundable.

Should a domain name dispute arise by any third party, or if any dispute arises under this Registration Agreement, the applicant agrees to abide by these terms and conditions. Please note that Ly domain registration is on a first-come, first-serve basis.

Should a domain name fail to register due to technical difficulties (i.e. server shutdown, power outage) beyond Register.ly’s control, Register.ly is not and will not be held responsible for a loss of such domain should it be registered afterward by a different applicant. Register.ly will refund the registration fee should the first applicant cannot register the domain.

Transfer-in/ Transfer-out policy

Clients who would like to transfer their domains from another .ly reseller to Register.ly are required to pay one year’s renewal as a transfer fee (The domain will be renewed for one year); this is also the same in case you decide to transfer your domains from Register.ly to another reseller (Your domain will also be renewed for one year).

This Registration Agreement shall be governed in all respects by and construed by the laws of General Post and Telecommunications Company (GPTC) (and, without respect to its conflict of law rules. This Registration Agreement is the complete and exclusive agreement between the applicant and the (parties) regarding domain names. It supersedes, and its terms govern, all prior proposals, agreements, or other communications between the parties.

 

.LY Registery Regulation

This Regulation outlines the terms and conditions for registering domain names under the country code Top-Level Domain (ccTLD) of LIBYA (“.ly”) with the General Post and Telecommunications Company (GPTC) or whoever is acting on its behalf.

1 DEFINITIONS

For the purposes of this Regulation, the following definitions shall apply:

1.1 GPTC or whoever is acting on its behalf: General Post and Telecommunications Company is the registration authority of the domain name space for the country code Top-Level Domain (ccTLD) of LIBYA (“.ly”). Thus, GPTC or whoever is acting on its behalf is responsible for the registration of domain names under the second-level domains (e.g., com.ly, plc.ly org.ly, gov.ly, edu.ly, med.ly, sch.ly, id.ly and net.ly). This includes the operation and management of DNS root servers for the Libyan (“.ly”) ccTLD.

1.2 Applicant/Registrant: Any entity or person that approaches GPTC or whoever is acting on its behalf or a recognized Registrar to register a new domain name or modify the information of an already registered domain name.

1.3 Registrar: An entity recognized by GPTC or whoever is acting on its behalf to administer the process of registration and modification of domain names under the second-level domains: com.ly, org.ly, med.ly, sch.ly, id.ly, net.ly…etc

1.4 Regulation: It is this document (Domain Name Registration Regulation in LIBYA) which consist of terms and conditions that define the relation between the Applicant and GPTC or whoever is acting on its behalf regarding the registration of a domain name under ccTLD of Libya (“.ly”).

Application form: A form exists for registering a new domain name or modifying information for an already registered domain name. It will be available at the www.nic.ly web site and the sites of the recognized registrars.

2 GENERAL

2.1 GPTC or whoever is acting on its behalf administers the name space for LIBYA ccTLD (“.ly”), under which a number of second-level domains exists.

2.2 The Libyan ccTLD (“.ly”) domain hierarchy is based on general category of organizations. The following are their definitions:

com.ly: Dedicated only for entities that provide commercial services. Also, registered trade names and marks can be registered as domain names under com.ly.
plc.ly: Dedicated only to entities operating as state owned companies.
edu.ly: Dedicated only for educational and training institutions, e.g., universities, training institutes, etc.
sch.ly: Dedicated only for Kindergartens, elementary schools, secondary schools, and high schools.
med.ly: Dedicated only for entities that provides health services such as hospitals, medical clinics, pharmacies, etc.
gov.ly: Dedicated only for Governmental entities including popular congresses and comities, ministries, authorities and government agencies.
net.ly: Dedicated only for entities that provide Internet-related services, e.g., ISPs, web hosting, portal sites, etc.
org.ly: Dedicated only for non-profit organizations including societies, charities, clubs and youth federations.
id.ly: Dedicated only for entities or individuals that do not fit within any of the above definitions, including personal names.

3 APPLICATION

3.1 The Applicant should fill in a domain name Application form and submit it to GPTC or whoever is acting on its behalf or one of its recognized registrars.

3.2 Registration of second-level domains should be through the recognized entities below:

3.2.1 Second-level domains; gov.ly, edu.ly and plc.ly can only be registered with GPTC or whoever is acting on its behalf and
not the recognized registrars.

3.2.2 Second-level domains: com.ly, org.ly, med.ly, sch.ly, id.ly, net.ly can be registered at any of the recognized registrars.
3.3 Domain name requests are kept in a pending state until all the requirements are received from the Applicant within three weeks from the application form submission date. If no such requirements are submitted within this period, GPTC or whoever is acting on its behalf will contact (by e-mail) the Applicant asking them to complete their request. If nothing is received within a week, GPTC or whoever is acting on its behalf will reject the request.

3.4 GPTC or whoever is acting on its behalf is not under any legal obligation to screen requested domain names to determine if the use of a domain name by an Applicant may infringe upon the right(s) of a third party. Consequently, as an express condition of the grant of an Applicant’s request to register a domain name, the Applicant represents, agrees and warrants as follows:
3.4.1 The Applicant bears the responsibility of obtaining legal permission to use the domain name which means that the use or registration of the domain name by him does not interfere with or infringe upon the right of any third party in any jurisdiction with respect to trademark, trade name, company name or any other intellectual property right.
3.4.2 It is the Applicant’s responsibility to secure a tradename or such to protect his right to the chosen name.

3.5 The Applicant certifies that, to the best of his/her knowledge the domain name is not being registered for any activities/purpose not permitted under Libyan law.

3.6 The Applicant certifies that, all information contained in the Application form is complete, correct, true and accurate.

3.7 The Applicant agrees to inform GPTC or whoever is acting on its behalf of any changes, amendments or corrections to the information provided in the application form as soon as such changes, amendments or corrections occur. This follows that:
3.7.1 Any notices and notifications required to be given under this regulation by GPTC or whoever is acting on its behalf to the Applicant will be deemed to have been given if delivered in accordance with the provided contact information.
3.7.2 The Applicant is aware that the information provided to GPTC or whoever is acting on its behalf related to a domain name such as the Registrant’s name, telephone number, facsimile number, e-mail address and other contact details will be publicly accessible through GPTC or whoever is acting on its behalf ’s server or in any form or media so deemed fit by GPTC or whoever is acting on its behalf.

4 REGISTERING DOMAIN NAMES

4.1 GPTC or whoever is acting on its behalf registers domain names on first come, first served basis.

4.2 Domain names must not contain obscene, scandalous, indecent, or contrary to Libyan law or Islamic morality words, phrases nor abbreviations.

5 DOMAIN NAME CONFLICTS

5.1 Any disputes between parties over the rights to use a particular domain name are to be settled between the contending parties using normal legal methods. GPTC or whoever is acting on its behalf exempts itself from all responsibility for the verification of rights to a name. GPTC or whoever is acting on its behalf cannot act as arbiter of disputes arising from this kind of conflict.

5.2 GPTC or whoever is acting on its behalf will not be liable for any interruption of business or any indirect damages of any kind (including losses of profits) or otherwise.

5.3 GPTC or whoever is acting on its behalf may suspend the registration of a pending application for a disputed domain name in case of a conflict with another pending application or an already registered domain name until the conflicting registrants present a signed and written settlement of the conflict.

5.4 Acceptance of an application and registration of a domain name by GPTC or whoever is acting on its behalf does not endorse approval or support to submitted names of natural or legal identities, trade names or trademarks.

6 APPLICATION REJECTIONS

6.1 GPTC or whoever is acting on its behalf will notify Applicants of acceptance, rejection or modification, by email.

6.2 Reasons for GPTC or whoever is acting on its behalf to reject domain name applications are:
6.2.1 Incomplete or incorrect entries in the Application form.
6.2.2 The domain name is not correctly hosted in the name servers.
6.2.3 The Applicant or his request does not comply with GPTC’s or whoever is acting on its behalf regulations.

7 MODIFYING REGISTRATION INFORMATION

7.1 Modifications are done only to contact and server information.

7.2 To edit domain names’ contact and server information, the Application form “Editing Information” should be used.
7.2.1 The Application form “Editing Information” will be found on the www.nic.ly website or at the recognized Registrars sites.

7.3 Request to make any such modifications must come from the Applicant/Registrant to GPTC or whoever is acting on its behalf or to the recognized Registrars. GPTC or whoever is acting on its behalf may take some additional measures to verify information for administrative reasons.

7.4 Changes of IP address and/or hosting Registrars are free of charge.
7.4.1 The Applicant/Registrant must communicate changes as to IP address and/or hosting Registrars to GPTC or whoever is acting on its behalf as soon as they are confirmed.

8 DELETING A REGISTERED DOMAIN NAME

8.4 GPTC or whoever is acting on its behalf reserves the right to suspend or delete a domain name at any time in any of the following cases:
8.4.1 GPTC or whoever is acting on its behalf finds any of the information supplied to GPTC or whoever is acting on its behalf to be incomplete, incorrect or inaccurate.
8.4.2 The Applicant/Registrant is in violation of any of the terms and conditions in this Regulation.
8.4.3 An order is received from a Libyan court.
8.4.4 Deleted domain name will be put on hold for 3 (three) weeks before it becomes available for reuse to other applicants, unless necessity dictates deleting it permanently or putting it on hold for longer periods.

9 REGISTRATION FEES AND EXPIRATION DATE

9.1 For any new or registered domains there will be an annual registration and maintenance fee of (35) LD.
9.2 If the payment is not received within 8 weeks of the expiry date, the domain name will be deleted.
9.3 Libyan NGOs and public educational institutions will be exempt of any registration or maintenance fees.

10 GOVERNING LAW

10.1 This Regulation shall be interpreted and construed under Libyan Law.

11 LANGUAGE

11.1 The Arabic language is the language of interpretation, correspondence and the construction of the Regulation or anything related to it. However, the parties may use the English language for correspondence. In case of conflict between the Arabic and the English versions the Arabic version shall prevail.
